New Jersey has specific statutory requirements governing how firearms must be transported. These rules differ depending on whether an individual holds a valid Permit to Carry and whether the firearm is being transported under a statutory exemption.

Transporting Firearms Without a Permit to Carry

Individuals who do not hold a valid New Jersey Permit to Carry must transport firearms strictly within the statutory exemptions outlined in N.J.S.A. 2C:39-6.

The “Directly to or from” Requirement

New Jersey transport exemptions generally require travel to be directly between authorized locations. Unnecessary deviations from the route may jeopardize the applicability of the exemption.

Brief and reasonable stops incidental to travel may be permissible, but extended detours or unrelated stops may create legal risk.

Transporting Firearms with a Valid Permit to Carry

A valid New Jersey Permit to Carry authorizes the permit holder to carry a handgun on their person, including while inside a vehicle, except when entering statutorily prohibited locations.

If a permit holder must leave a firearm unattended in a vehicle or enter a restricted location, storage and transport provisions under N.J.S.A. 2C:39-6 and 2C:39-6g may apply.

New Jersey law imposes requirements when a firearm is left unattended in a vehicle. Firearms must be secured in accordance with statutory storage provisions.

  • Store in a locked container or locked trunk.
  • Ensure the vehicle is locked.
